These terms cover your use of the Earshelf app, published by Joao Vitor Humenhuk Achutti, a sole trader, 38 Allenby Street, Tel Aviv-Jaffa 6332512, Israel.
Earshelf is a diary and planning tool for audiobooks. It doesn't play, sell or lend audiobooks, and it has no connection to Audible, Libby, OverDrive, Spotify, Everand, Apple Books or any other store or library. Prices and availability come from what Apple Books publishes and from what you record, so check them with the store or library before you buy or borrow.
The diary, shelves, ratings, the where-to-listen list, loans, holds, credits, widgets and the Apple Watch app are free, with no time limit. Earshelf Pro adds price alerts, the full listening statistics and more than one library card. Earshelf Patron includes everything in Pro and adds alternate app icons and your own cover photos. Nobody has to pay to keep using what they have logged.
Payment is charged to your Apple Account. A subscription renews automatically unless it is canceled at least 24 hours before the period ends. Manage or cancel it in Settings on your device. Where a free trial is offered, any unused part of it is forfeited if you buy a subscription during the trial.
Everything you have logged stays, and you can still read and export it. Price alerts stop, the full statistics close, and you can't add another library card until you subscribe again.
What you put into Earshelf is yours. It is stored on your device and, if you share or sync it, in your own iCloud account. The publisher claims no rights over it and does not hold a copy.
Purchases are made through Apple, and refunds are handled by Apple under the terms of the App Store. Write to earshelf@humenhuk.com if something has gone wrong and we will help where we can.
Earshelf is provided as it is. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Subject to that, liability is limited to the amount you have paid for Earshelf in the twelve months before the claim.
These terms are governed by the law of the State of Israel, and its courts have exclusive jurisdiction.
